Liberty has three key principles on human rights that we want to see the negotiators respecting.

Now we’ve lost the Charter, it’s more important than ever that we hold the Government to its commitment that we will not leave the EU with fewer rights.

The explicit dialogue initiated by the UK Supreme Court in this saga may incorporate recognition of constitutional pluralism in the legal reasoning of UK human rights law.

In doing so it may undermine the authority of both the UK Supreme Court and the legal system it serves.

These unprecedented powers threaten our rights and equality protections by allowing a handful of ministers to change vital domestic laws like the Equality Act, the Modern Slavery Act and the Data Protection Act.

Brexit white paper On 12 July, the Government published its ‘Brexit white paper’ – a document setting out its policy on the future relationship between the UK and the EU.

But that isn’t all the white paper says the Bill will do.

It suggests amending the EU Withdrawal Act – the one Parliament just passed.

The proposed extension would mean they don’t expire until 31 December 2022 – well after the current expiry date of 29 March 2021.

This would further damage legal certainty and access to justice by making it harder, if not impossible, for people to know the law – while giving ministers even greater leeway to tinker with our rights without robust oversight from Parliament.
